This webinar will provide an overview of current regulation on NHCR, its objective and scope which will verify how your product could be profiting from several different kinds of claims such as nutrition, health (functional), reduction of disease risk and children claim and how to use them. It will review the subsequent pieces of legislation that implement and develop it, including ECJ (European Court of Justice) interpretation. We will study what cases are covered by this legislation and which are excluded, how it applies to voluntary and compulsory information and to situations such as cosmetic or medicinal claims. In this presentation we will also explain several different kinds of claim. Each of these claims is different regarding the kind of benefit they refer to and are subject to different conditions of use.

We will briefly refer to the registration process for new claims and the possibility that a claim is reserved for five years for the exclusive use of the company that successfully applied for it.

Vicente Rodriguez Fuentes is a Spanish lawyer specialized in food Law and has a wide experience in regulatory affairs and in litigation in the field of food law, where he has advised numerous European and international companies and organisations.

He was educated at the Universities of Seville, Spain, (law degree) and Liege, Belgium, (Masters Degree in European Law avec distinction) and served internship at Directorate General of Internal Market and Industrial Affaires of the European Commission. He is the author of numerous articles on Food Law published in Law reviews in Spain, Germany, Italy and the EU.

He has edited the book From agricultural to food law, the new scenario (Wageningen Academics Publ. 2014), directed the book El Derecho Agroalimentario (Agrifood Law, Edit. Bosch 2003) and participated in the books UE. Sociologia y Derecho Alimentario (Thomson Reuters 2013) and Lecciones de Derecho Aliemtario 2015/16 (Thomson Reuters 2015) 6. He has written the legal section of the Spanish Ministry of Agriculture/Spanish Food and Beverage Federation (FIAB) Guidelines on the Food Alert System. He participates regularly in international seminars and conferences on food law and is an invited professor at the University of the Balearic Islands in a Master Degree on Nutrigenomics and Personalised Nutrition. Mr. Vicente Rodríguez is the vice-president of the European Food Law Association.

Topic Background:

The regulation of health and nutrition claims on food products, including reduction of disease risks and children's claims, is harmonized throughout the European Union. Regulation 1924/2006 -NHCR- is one of the most important pieces of legislation of EU Food Law. It is a complex regulation requiring prior authorization and scientific substantiation for all claims.

This legislation applies to claims made in the presentation of food, including labeling, packaging, advertising or any other form of commercial communication. NHCR also regulates comparative nutrition claims.

All food companies marketing their products in Europe should be familiar with this legislation and on how it has been implemented by authorities and interpreted by courts.
